Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Launchpad's services, including Launchpad Boost, Launchpad Automation, and all related platforms, software, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

Service Description

Launchpad provides AI-powered automation platforms designed to optimize business operations, including:

  • Launchpad Boost: Automated local SEO optimization and Google Business Profile management
  • Launchpad Automation: Custom AI agent development for business automation
  • Related tools, analytics, and reporting features

Account Registration and Responsibilities

Account Creation

To use our Services, you must:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have the authority to enter into this agreement

Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

Subscriptions and Payments

Subscription Plans

Our Services are offered on a subscription basis with monthly billing. Pricing varies by product and service tier.

Billing

  • Subscriptions automatically renew monthly unless canceled
  • Fees are charged in advance on the renewal date
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • Failed payments may result in service suspension

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial months.

Google Business Profile Authorization

By using Launchpad Boost, you authorize us to:

  • Access and manage your Google Business Profile
  • Make updates, posts, and optimizations on your behalf
  • Monitor rankings and analytics data
  • Implement SEO strategies and techniques

You retain ownership of your Google Business Profile and may revoke access at any time.

Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Provide false or misleading information
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our Services
  • Use our Services for illegal or fraudulent purposes
  • Reverse engineer or copy our software or technology
  • Resell or redistribute our Services without authorization

Intellectual Property

All content, features, and functionality of our Services are owned by Launchpad and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without written permission.

You retain ownership of content you provide to us. By using our Services, you grant us a license to use, store, and process your content to provide our Services.

Service Level and Performance

While we strive for 99.9% uptime, we do not guarantee:

  • Uninterrupted or error-free service
  • Specific SEO rankings or results
  • Compatibility with all third-party services
  • That our Services will meet all your requirements

We may modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • LAUNCHPAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR LOSSES CAUSED BY THIRD-PARTY SERVICES (INCLUDING GOOGLE)

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Indemnification

You agree to indemnify and hold Launchpad harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

Termination

We may suspend or terminate your access to the Services:

  • For violation of these Terms
  • For non-payment of fees
  • If required by law
  • At our discretion with or without cause

Upon termination, your right to use the Services immediately ceases. We will delete your data in accordance with our Privacy Policy.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions.

Arbitration

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in Palm Beach County, Florida, rather than in court, except that you may assert claims in small claims court if they qualify.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the modified Terms.

General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Launchpad
  • Severability: If any provision is found unenforceable, the remainder shall remain in effect
  • Waiver: Failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms without our consent
  • Force Majeure: We are not liable for delays caused by circumstances beyond our control
